Terms of Service

By using our services, you agree to the following:

By utilising the services provided by or on behalf of Companion Cab (Pty) Ltd, you hereby acknowledge and agree to be bound by the terms and conditions, detailed below:

DEFINITIONS

Company: Companion Cab (Pty) Ltd, a private company registered in the Republic of South Africa, with registration number 2022/719101/07.
Companion: Any employee, agent, driver, or other person affiliated with the Company, whether on a permanent, temporary, or contractual basis.
Client: The person responsible for payment of the services rendered by the Company or its Service Providers. Passenger: The person receiving the service. This may or may not also be the Client. However, should the Passenger and the Client not be the same person, the Client must expressly authorise the Passenger's use of the Client's account. This authorisation may be rescinded, in writing, at any time.
Service: Any service provided to the Client or the Passenger on behalf of the Company.
Agreement: These Terms of Service, which may be amended from time to time. Any amendments will require reacceptance of the Agreement, and the Company undertakes to notify clients in advance of any amendments scheduled to come into effect at a future date.

ASSUMPTION OF RISK

The Client understands that the services provided by the Company involve certain risks, and voluntarily assume all risks associated with the services and activities conducted by the Company, including, but not limited to, transportation, companionship, and related activities.

RELEASE OF LIABILITY

The Client releases the Company, and Companions, from any liability for any loss, damage, injury, or harm arising out of or in connection with the services provided by the Company, including any acts or omissions by the Companions, except in cases of gross negligence or wilful misconduct.

RESPONSIBILITY FOR PERSONAL BELONGINGS

The Client acknowledges that the Passenger is solely responsible for any personal belongings or items brought with them during the provision of services by the Company. The Company will not be liable for any loss, theft, damage, or misplacement of personal belongings.

INSURANCE COVER

While the Company does have public liability insurance, the Client understands that it is their responsibility to obtain the appropriate insurance and/or medical cover against any personal injury, loss, or damage that may occur during the provision of services by the Company. The Company does not provide any insurance cover for Clients, Passengers, or their personal belongings.

EMERGENCY CARE

In the event that the Passenger should experience a medical emergency, the Company authorises the Companion providing the Service to transport the Passenger to the nearest medical facility. Where possible, a state facility will be prioritised, unless the Client expressly instructs otherwise or medical aid/insurance details have been provided.

The Companion will contact the Company and notify them of the emergency and the Company will inform the Client or the listed emergency contact(s) of the emergency, and the actions taken, within an appropriate period of time.

BOOKINGS

There is no restriction on how much advance notice can be given on a booking. Same-Day Bookings (bookings with less than 12 hours' notice), however, incur an additional surcharge.

SERVICE FEES

Services are billed on a per-minute basis. In the event that the Services require transportation of the Client or Passenger, an additional per-kilometre fee will be charged. The Company reserves the right to amend the base fee temporarily, depending on external factors, such as Companion availability, time of day, and additional skills and/or services required. The Client will be notified of any inflation of the price at time of booking and the Client has the right to reschedule the booking or reject the quote entirely.

Base Fees

Companion Time: The period of time the Companion spends with the Client or Passenger
     R1.50 per minute
Distance: The distance that the Companion transports the Client or Passenger
     R9.50 per kilometre

Additional Fees

Distance Surcharge: A fee levied on booking falling outside the Companion's service area, charged at 50% of the per-kilometre rate on distances more than 10km from the Companion's base.
Minimum Charge Surcharge: A surcharge levied on bookings totalling less than the R100 minimum charge.
Same-Day Booking Surcharge: An additional fee of R50 is charged on bookings made less than 12 hours in advance.

QUOTES

When making a booking, the client must specify the nature of the booking. A quote will be generated for the Client's consideration. This is merely an estimate, based on the information provided by the Client. An exact fee will be calculated at the end of the booking, based on time, distance and any additional fees that may be due.

PAYMENT TERMS

On completion of the booking, the Client will be offered the option to pay by credit card, debit card or EFT. Cash payments are permitted by prior arrangement when making the booking. All booking fees must be settled within 72 hours of the booking's conclusion.

CANCELLATION AND REFUND POLICY

Cancellations are accepted, with a minimum of 24 hours' notice, at no charge. Cancellations made less than 24 hours in advance incur a cancellation fee of R100. Similarly, no-shows also incur a cancellation fee of R100 plus the distance travelled by the Companion, billed at R10.00 per kilometre.

In the event that a Client lays a formal complaint against a Companion, an internal investigation will be conducted into the complaint and a full or partial refund may be effected. Refunds are at the sole discretion of the Company management and the Company's decision is final. Formal complaints must be made in writing and submitted to support@companioncab.co.za.

COMPLIANCE WITH LAWS AND REGULATIONS

The Client agrees to comply with all applicable laws, regulations, and rules during the provision of the Services by or on behalf of the Company. The Client and/or the Passenger will not engage in any illegal, harmful, or disruptive activities that may compromise the safety or well-being of the Client, the Passenger, other Clients, or the Companion.

INDEMNITY

The Client agrees to indemnify and hold the Company harmless from any claims, demands, lawsuits, liabilities, damages, costs, and expenses (including legal fees) that may arise out of or in connection with the Client's use of the Company's services, the Client's breach of this Agreement, or any violation of applicable laws or regulations.

INTELLECTUAL PROPERTY

All intellectual property rights related to the Company's branding, website, and any proprietary technology or content, remain the exclusive property of the Company. Any violation of the Company's intellectual property rights will be subject to prosecution.

PRIVACY AND DATA PROTECTION

The privacy and protection of our Clients' personal data is of paramount importance, and any data breach will be investigated as a matter of the highest priority. The Company undertakes to notify affected Clients of such a breach within a reasonable period of time and inform Clients of any action taken to mitigate the consequences of such a breach.

GOVERNING LAWS AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.You indemnify Companion Cab (Pty) Ltd, its shareholders, directors, employees and agents or representatives from any and all claims, demands, losses, liability (under South African Law), fees, expenses and costs of any kind whatsoever including attorneys’ fees arising from the services, directly or indirectly, provided by Companion Cab (Pty) Ltd and agrees not to sue on any claim, or institute any action, related to or arising out of such services.
